Murphy v. Wal-Mart Inc.

On August 21, 2025, plaintiff John Murphy slipped on a wet floor near the dairy section of a Walmart store in Houston, Texas, fracturing his hip. He sued Wal-Mart Inc. for negligence, claiming no warning signs were displayed and the spill was left unattended for an extended period. Surveillance footage and employee testimony became central to the case. Murphy sought damages for medical costs, lost income, and pain and suffering. The trial examined whether the store followed its safety protocols and how quickly staff responded to the hazard.

In April 2026, the jury found Wal-Mart 80% liable and Murphy 20% liable for comparative negligence, awarding $2.1 million in total damages. The award was subsequently reduced to $1.68 million to reflect the plaintiff's share of fault.
