Case Reiwa 7 (Wa) 104 - Violation of the Act on Elimination and Prevention of Involvement in Bid Rigging, etc., Obstruction of Public Contract Bidding, Aggravated Acceptance of Bribes, and Bribery

In 2025, a major bid-rigging scandal erupted in Japan involving defense-related public contracts. Kazuhiro Matsuda, a senior official in charge of procurement, was indicted for orchestrating a bid-rigging scheme that favored Asahi Construction in exchange for cash payments totaling approximately 30 million yen and lavish entertainment. The charges included violations of the Act on Elimination and Prevention of Involvement in Bid Rigging, obstruction of public auction bidding under the Penal Code, aggravated acceptance of bribes, and bribery. Matsuda leaked insider bid specifications and predetermined winning bidders. The president of Asahi Construction, Kenji Sawada, was charged with bribery and complicity in obstructing fair bidding. The case exposed systemic collusion between government officials and private contractors in sensitive infrastructure projects.

The Tokyo District Court found both defendants guilty in late 2025. Matsuda was sentenced to 4 years in prison and ordered to forfeit the bribery proceeds. Sawada received a 2-year prison sentence suspended for 3 years, and Asahi Construction was fined 80 million yen. The central dispute revolved around whether Matsuda's actions constituted "involvement in bid rigging" as defined by the specialized anti-collusion law, and whether the bribes received met the standard for "aggravated acceptance of bribes" given his supervisory authority. The defense argued that the exchanges were legitimate consulting fees and that there was no direct proof of bid obstruction. The court also examined the scope of the public contract-related obstruction of bidding charge and its interplay with the anti-bid-rigging legislation.

The case triggered widespread public outcry and intensified scrutiny of Japan's defense procurement practices. It prompted the Ministry of Defense to implement stricter internal compliance measures and an independent review of all active contracts.
